These Terms of Service and Legal Notice (“Terms”) govern your access to and use of Bennitelli’s website, products, services, and purchases.
The website is operated by Bennitelli LLC (“Bennitelli,” “we,” “us,” or “our”).
By accessing our website, creating an account, placing an order, or purchasing a product, you acknowledge that you have read, understood, and agreed to these Terms, together with our Return & Refund Policy, Shipping Policy, Privacy Policy, and any other policies displayed on our website.
If you do not agree to these Terms, please do not use our website or purchase our products.

2. ELIGIBILITY AND WEBSITE USE
You may use our website only for lawful purposes and in accordance with these Terms.
You may not:
- Violate any applicable law or regulation.
- Attempt to gain unauthorized access to our website, accounts, servers, or systems.
- Interfere with the security or operation of our website.
- Use bots, scraping tools, automated purchasing systems, or similar technology without our written permission.
- Submit fraudulent orders, payment information, claims, chargebacks, or other information.
- Misrepresent your identity or impersonate another person.
- Use our intellectual property without authorization.
We reserve the right, to the extent permitted by law, to refuse service, cancel orders, restrict accounts, or terminate access where we reasonably believe fraud, abuse, policy violations, unauthorized resale, or unlawful activity has occurred.
3. ORDERS
Submitting an order does not necessarily constitute our final acceptance of that order.
We reserve the right to refuse or cancel an order before shipment where reasonably necessary, including because of:
- Inventory discrepancies.
- Pricing or product listing errors.
- Suspected fraud or unauthorized payment.
- Shipping restrictions.
- Technical errors.
- Duplicate orders.
- Product unavailability.
If we cancel a paid order before shipment, we will issue any refund required by applicable law.
Customers are responsible for reviewing their order, including product, color, size, quantity, shipping address, and contact information, before submitting payment.
4. PREORDERS, WAIT & SAVE, AND MADE-FOR-ORDER PRODUCTS
Certain Bennitelli products may be offered as Preorder, Wait & Save, made-for-order, or other advance-purchase products.
These products may be manufactured or ordered based in whole or in part on customer demand and therefore have different cancellation and return conditions from regular in-stock merchandise.
The estimated shipping timeframe applicable to a preorder will be disclosed on the applicable product page or during checkout.
Estimated preorder dates are estimates and are not guaranteed delivery dates. Manufacturing, freight, customs, carrier, inventory, quality-control, and other delays may occur.
If Bennitelli cannot ship within the time required under applicable law, Bennitelli will provide any notice, cancellation opportunity, or refund required by applicable law.
FINAL SALE AFTER SHIPMENT
Unless otherwise required by law, all Preorder, Wait & Save, and other products clearly identified as final sale are FINAL SALE once shipped and are not eligible for voluntary returns, refunds, or exchanges.
By purchasing an item clearly identified as a Preorder, Wait & Save, or final-sale product, you acknowledge and agree to this condition before completing your purchase.
This final-sale restriction does not eliminate any rights that cannot legally be waived, including rights relating to products that are materially different from what was ordered or other rights required by applicable law.
PREORDER CANCELLATIONS BEFORE SHIPMENT
Requests to cancel a preorder before shipment should be sent to support@bennitelli.com.
Any voluntary cancellation policy stated on the applicable product page or Return & Refund Policy will apply, subject always to cancellation and refund rights required by applicable law.
Once an order has been shipped, it cannot be cancelled and the final-sale provisions above apply.
5. SHIPPING TIMEFRAMES
Shipping and delivery dates displayed on our website are estimates unless expressly stated otherwise.
Bennitelli will comply with applicable laws concerning advertised shipping timeframes, shipping delays, customer consent to delays, cancellation rights, and refunds.
A shipping label being generated does not necessarily mean that a carrier has physically received the package.
“Shipped” means the merchandise has been physically tendered to or placed in the possession of the applicable carrier.
6. SHIPPING ADDRESSES
Customers are responsible for providing a complete and accurate shipping address.
Bennitelli is not responsible, to the fullest extent permitted by law, for delivery problems caused by an incorrect, incomplete, outdated, or improperly entered address supplied by the customer.
If an order is returned to Bennitelli because of an address provided incorrectly by the customer, additional shipping charges may apply before the order is reshipped.
Orders generally cannot be redirected after they have been transferred to the carrier.
7. LOST, STOLEN, MISDELIVERED, OR MISSING PACKAGES
Once an order has been transferred to the shipping carrier, delivery is performed by an independent third-party carrier.
If tracking shows a package as delivered but the customer cannot locate it, the customer should first:
- Check the delivery location, mailbox, parcel locker, front desk, mailroom, and surrounding property.
- Check with household members, neighbors, building management, or reception staff.
- Allow a reasonable period after the delivery scan, as some carriers may scan packages before final placement.
- Contact the applicable shipping carrier and initiate a missing-package inquiry when appropriate.
Bennitelli will reasonably assist customers with available tracking information and carrier inquiries.
To the fullest extent permitted by applicable law, Bennitelli is not responsible for theft, loss, disappearance, or misplacement occurring after a carrier records a shipment as delivered to the shipping address supplied by the customer.
A carrier delivery scan may be considered evidence of delivery, subject to applicable law and any contrary evidence.
Nothing in this section limits any rights or remedies that cannot legally be waived.
8. PACKAGES LOST IN TRANSIT
If carrier tracking indicates that a package may have been lost before delivery, please contact us at support@bennitelli.com.
We may request that the customer cooperate with a carrier investigation or provide information reasonably necessary to investigate the shipment.
Any refund, replacement, claim, or other remedy will be handled in accordance with applicable law and the circumstances of the shipment.
9. SHIPPING DELAYS
Bennitelli is not responsible, to the fullest extent permitted by law, for carrier delivery delays occurring after timely shipment due to circumstances outside our reasonable control, including severe weather, transportation disruptions, carrier congestion, customs delays, labor disruptions, natural disasters, or other similar events.
However, nothing in these Terms limits any statutory rights relating to Bennitelli’s obligation to ship merchandise within an advertised or legally required timeframe.
10. RETURNS AND REFUNDS
Regular, eligible, non-final-sale merchandise is governed by our separate Return & Refund Policy, which is incorporated into these Terms by reference.
Items marked Final Sale are not eligible for voluntary return, refund, or exchange unless otherwise required by applicable law.
Preorder and Wait & Save merchandise is subject to the special terms described above.
Products returned without authorization, outside an applicable return period, worn, washed, damaged after receipt, altered, missing original packaging or tags, or otherwise failing to satisfy our Return & Refund Policy may be denied a voluntary refund or exchange to the extent permitted by law.
Original shipping charges are non-refundable on voluntary returns unless otherwise stated or required by law.
11. ORDER ISSUES AND INCORRECT ITEMS
Customers should inspect their orders promptly after delivery.
If you receive an incorrect item, incorrect size relative to what was ordered, materially defective product, or materially damaged merchandise, contact support@bennitelli.com promptly with your order number and photographs where reasonably necessary to evaluate the issue.
Bennitelli may provide a replacement, refund, return label, or other appropriate remedy depending on the circumstances and applicable law.
12. CHARGEBACKS AND PAYMENT DISPUTES
Customers are encouraged to contact support@bennitelli.com regarding an order issue before initiating a payment dispute so that we have an opportunity to investigate and resolve the matter.
Bennitelli reserves the right to provide payment processors, financial institutions, and card networks with relevant transaction information when responding to a payment dispute, including order records, checkout information, policy acceptance records, correspondence, tracking information, proof of shipment, and proof of delivery.
Nothing in this section limits a customer's lawful rights under applicable payment or consumer-protection laws.
13. PRICING AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, prices, sizes, colors, inventory information, and other information are accurate.
However, occasional errors may occur.
We reserve the right to correct errors, inaccuracies, or omissions and, where permitted by law, cancel an affected order.
If a paid order is cancelled, we will provide any refund required by applicable law.
Colors and appearance may vary slightly because of lighting, photography, manufacturing variation, and differences in device displays.
Minor variations that do not materially change the product are not necessarily defects.
14. PROMOTIONAL CODES AND DISCOUNTS
Discount codes, promotional offers, store credits, and other promotions may be subject to additional conditions.
Unless otherwise stated:
- Promotions cannot be combined.
- Discounts have no cash value.
- Discounts cannot be applied retroactively to completed purchases.
- Promotions may be modified or discontinued to the extent permitted by law.
- Promotional codes may be limited to specified customers, products, dates, or quantities.
15. INTELLECTUAL PROPERTY
All content appearing on the Bennitelli website, including text, photographs, graphics, videos, logos, product names, product designs, website designs, branding, trademarks, trade dress, and other materials, is owned by or licensed to Bennitelli LLC and is protected by applicable intellectual-property laws.
No Bennitelli content may be copied, reproduced, distributed, republished, modified, displayed, sold, exploited, or used commercially without prior written authorization.
Nothing on our website grants any license or right to use Bennitelli intellectual property except as expressly authorized.
16. REVIEWS AND USER-SUBMITTED CONTENT
If you voluntarily submit a review, photograph, comment, testimonial, social-media content, or other material to Bennitelli, you represent that you have the right to provide that material.
To the extent stated at the time of submission and permitted by law, you grant Bennitelli permission to use submitted material for business and promotional purposes.
Bennitelli will not knowingly publish false or misleading reviews or materially alter customer reviews in a manner that misrepresents the customer's opinion.
17. THIRD-PARTY SERVICES
Our website may use or link to services operated by third parties, including payment processors, shipping carriers, social-media platforms, ecommerce providers, and other service providers.
Bennitelli does not control third-party websites and is not responsible for their independent content, availability, security, or privacy practices.
Your use of third-party services may also be subject to their own terms and policies.
18. FRAUD AND ABUSE
Bennitelli reserves the right to investigate suspected fraudulent or abusive activity and, where permitted by law, cancel or refuse orders associated with suspected:
- Payment fraud.
- Unauthorized payment methods.
- False claims.
- Return fraud.
- Promotional abuse.
- Resale abuse.
- Repeated fraudulent chargebacks.
- Attempts to circumvent these Terms.
We may preserve and provide relevant records to payment processors, carriers, law enforcement, or other appropriate parties where legally permitted or required.
19. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE EXTENT PERMITTED BY APPLICABLE LAW, BENNITELLI DISCLAIMS WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
SOME STATES OR JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS. ACCORDINGLY, THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
NOTHING IN THESE TERMS DISCLAIMS OR LIMITS A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.
20. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BENNITELLI LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE WEBSITE, PRODUCTS, SERVICES, OR THESE TERMS.
TO THE FULLEST EXTENT PERMITTED BY LAW, BENNITELLI’S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PRODUCT OR TRANSACTION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO BENNITELLI FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.
21. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Bennitelli LLC and its members, employees, agents, contractors, and affiliates from claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of our website, violation of these Terms, infringement of another party’s rights, or fraudulent conduct.
22. FORCE MAJEURE
To the fullest extent permitted by law, Bennitelli will not be responsible for delays or failures caused by circumstances outside its reasonable control, including natural disasters, severe weather, fires, floods, epidemics, governmental actions, war, civil unrest, labor disruptions, carrier interruptions, transportation disruptions, widespread internet or utility outages, customs delays, or supply-chain interruptions.
This provision does not eliminate any cancellation, notification, refund, or other consumer right required by applicable law.
23. GOVERNING LAW
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable federal law or another jurisdiction’s mandatory consumer-protection law provides otherwise.
To the extent legally permitted, disputes arising from these Terms or purchases from Bennitelli shall be brought in a court of competent jurisdiction located in Illinois.
Nothing in this provision deprives a consumer of protections that cannot lawfully be waived.
24. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed, and the remaining provisions will continue in full force and effect.
25. NO WAIVER
Bennitelli’s failure to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision or our right to enforce it later.
26. CHANGES TO THESE TERMS
We may update these Terms periodically.
Changes become effective when posted unless otherwise stated. Changes will not retroactively eliminate rights that have already vested under applicable law.
The version of the Terms in effect at the time of a transaction will generally govern that transaction, subject to applicable law.
